Concept Note

Today with the confluence of Law and technology, digitization has massively increased. Cyberspace is presenting far more new distinctive challenges, issues and perspectives. This advancement holds particular importance for developing countries as the world has already entered into the golden age of digital revolution and with influence of technology on law in its ambit, focus, impact and frequency,
there are number of crucial issues concerning the digital environment and their regulations that are throwing up contentious issues by the members of digital stakeholder community. Despite the potential benefits, this revolution also poses new types of risks. The lack of security standards in the business models, misuse of personal data, electronic frauds, and cybercrimes are among the major vulnerabilities of the new digital era.

At the center of the law and policy debate is how this new area of technology should be regulated and supervised. This FDP aims to act as a catalyst for discussions on the key aspects of Cyberspace, and its future trends and impacts, including legal, ethical, social, policy and regulatory issues thereof and present an integrated, holistic and strategic view of the issues therein, whilst recognizing that there is an urgent need for effective global cooperation on cyber issues amongst all stakeholders. The experts in the FDP will deliberate on contemporary challenges posed by technological advancement in laws.

In this FDP, faculty members and resource persons will seek to explore the answers to this and other similar technological miscellanies. This FDP re-emphasizes on the importance of new technologies for understanding and utilizing the digital transformation of Law. It further highlights the need to support the legal sector and academia’s engagement in a tech-inclusive industry. This FDP is designed for teachers and educators to deliberate and learn about the interface between Law and Technology, the fintech revolution, and contemporary legal responses to techno-legal advancement in the field of artificial intelligence, machine learning, cryptocurrencies, blockchain and big data. We will also be deliberating on the challenges faced in education and research in the present digital era in terms of Innovation, Incubation, Start-ups, governance and regulatory issues in India.

Objectives

  • To provide orientation and training on the current legal problems encountered by the confluence of Law and Technology.
  • To identify the distinctive legal, policy, regulatory and technical challenges, issues and nuances thrown up by growing cyber security breaches and the potential approaches being adopted in this regard to deal with them.
  • To train the faculty to inculcate the skills required by engaging technology related courses.
  • To augment organizational capacities to assess the impact of legal response to current technological challenges.
  • To create a culture of developing comprehensive legal responses and reforms towards the identified gaps between Law and Technology.

Expected Outcomes

  • Understand the theoretical and practical concepts relevant to privacy and data protection, emerging technology, platform governance, cybersecurity and information security, intellectual property, and competition law.
  • Evaluate various domestic cyber laws, including laws associated with technology and information law and policy, intellectual property and competition law with the support of experts engaging the sessions.
  • Develop new pedagogies in line with the best practices followed by emerging law schools.
  • Draft new courses to prepare 21st century lawyers to meet the techno-legal challenges posed by the digital revolution in law.

  • Full-time faculty members of Law Universities and Law Schools are eligible.
  • Accommodation will be provided on request.
  • Attendance for all sessions is mandatory.
  • All the participants shall be awarded a certificate on successful completion of the programme
